N1 Billion 'Sun Girl' Suit: NCC To Meet With Girl's Lawyer
The Nigerian Copyright Commission, NCC, has scheduled Monday, 18th July 2016, to meet with the lawyer representing Miss Akinyemi Temitope, the lady whose picture was wrongly used as 'Sun Girl' in the DailySun Newspaper on Wednesday, May 25, 2016.
An Abuja-based law firm, Felix, Igelige & Associates, represented by Barrister Rockson A. Igelige, has accused Daily Sun of the illegal and criminal publication of a photograph of Miss Akinyemi Temitope, a Polytechnic student in the newspaper’s May 25, 2016 edition on its ‘Sun Girl’ page and is demanding N500 million as damages for copyright infringement and illegal publication and another N500 million for invasion of privacy through the publication without the prior permission of the owner.
Recall that in that edition, Daily Sun published the photograph of Miss Akinyemi Temitope, a student of Delta State Polytechnic, Ozoro, Delta State, with the name Sadiyat’ and telephone number 09057312447 in the dating ‘Sun Girl’ page, a publication that she alleged caused her embarrassment and emotional trauma from the break-up of her five year old relationship.
A statement signed by Mr. Rockson A. Igelige, a University of Westminster, London trained Entertainment Lawyer, on behalf of the law firm and addressed to The Editor, Daily Sun, Mr. Onuoha Ukeh on 31st May, 2016, and entitled ‘INFRINGEMENT OF THE COPY RIGHT AND DEROGATORY USE OF MISS AKINYEMI TEMITOPE`S PHOTOGRAPH AND INVASION OF HER PRIVACY BY YOUR PUBLISHING COMPANY', stated, “We act as solicitors to Miss. Akinyemi Temitope, a student of the Delta State Polytechnic, Ozoro, Delta State (our client) and we write this letter on her behalf.
“Our client is the author and copyright owner of the photograph that your publishing company used on page 3 (three) of the Daily Sun of 25/5/2016 at volume 12 at Number 3413 bearing the name ‘SADIYAT’ with the Telephone No. 09057312447 under the heading SUN GIRL.
“Our client does not bear such name as ‘Sadiyat’ and she does not use that mobile number. The image in that photograph is our client and it was our client that created that photograph which by extension is the copyright owner of that photograph your Publishing Company used as mentioned above without her permission, consent or authorization.
The letter further stated; “Our client’s attention has been drawn to your use, without permission or licence of her artistic work (photograph). Specifically, you have appropriated the work as a photograph in your Daily Sun of 25/5/16 at page 3 with the heading SUN GIRL in your volume 12 No. 3413 publication and have sold same to your customers nationwide. This artistic work (photograph) of our client can also be downloaded from your website too at www.sunnewsonline.ng.
Igelige indicts the newspaper: “By not obtaining our client’s prior permission, consent or license before engaging in this act, your company’s conduct amounts to flagrant and deliberate infringement and derogatory use of her copyright as well as invasion of her privacy.
This unauthorized publication and illegal appropriation of her copyright has caused our Client serious embarrassment that has led to the break-up of her relationship of well over five years. Our client is now being treated as a public outcast by her friends and school mates”.
Among other things, the law firm of Felix, Igelige & Associates is demanding:
That Daily Sun pays N500 million for the unauthorized and derogatory use of her artistic work (photograph).
That Daily Sun pays to another sum of N500, 000,000.00 (Five Hundred Million Naira only) for the deliberate and unauthorized invasion of her privacy and causing her serious embarrassment, emotional trauma and break up of her relationship with her fiancé.
The law firm gave Daily Sun seven days’ notice to respond to its letter of demand .
Speaking to Firstng on the latest development, Igelige said, "we have to take the case to NCC when we waited well over seven days for DailySun's response. We trust NCC will take the next step to restore our client's infringed rights after our scheduled meeting".

Poly Student Demands N1 billion From Daily Sun For Illegal, Criminal Use of Photograph

The letter further stated; “Our client’s attention has been drawn to your use, without permission or licence of her artistic work (photograph). Specifically, you have appropriated the work as a photograph in your Daily Sun of 25/5/16 at page 3 with the heading SUN GIRL in your volume 12 No. 3413 publication and have sold same to your customers nationwide. It would be recalled that a similar copyright infringement in 2007 in which Grapevine Communication Limited illegally published the photograph of Mr. Peter Obe attracted N10 million legal suit; which the Federal High Court, Lagos, decided in favour of Mr. Obe in Peter Obe VS. Grapevine Communication LTD (2003-2007)5 I.P.L.R.
Among other things, the law firm of Felix, Igelige & Associates is demanding:
That Daily Sun pays N500 million for the unauthorized and derogatory use of her artistic work (photograph) in your Publishing Company on the 25/5/2016.
That Daily Sun ceases and desists from further infringing on the copyright of our client as regards the aforementioned photograph.
That Daily Sun pays to our client another sum of N500, 000,000.00 (Five Hundred Million Naira only) for the deliberate and unauthorized invasion of her privacy by your Publishing Company on the 25/5/2016 thereby causing her serious embarrassment, emotional trauma and break up of her relationship with her fiancé.
The law firm has given Daily Sun seven days’ notice to respond to its letter of demand otherwise it would seek remedy to restore its client’s infringed rights, “including legal action for injunctive relief, criminal charges and damages, without further notice to you”.

Iginla also gave out money running into several millions of naira to the aged, widows, orphanages and scholarships to orphans from nursery school to university.
Six Nollywood actors and actresses got Hummer jeep 3 series, Mercedes G-Wagon and Mercedes CLS 550. They include Jide Kosoko, Francis Duru, Alex Usifo, Ngozi Osondu, Thelma Nwosu and Sunday Omobolanle, popularly known as Babasuwe.
Artisans got generators and cash gifts while the widows got deep freezers, rice and cash gifts ranging from N150,000 to N1.5 million.
Treasure Orphanage Foundation, Nyanya, Divine World Orphanage, Kubwa and Christ Home Foundation, Kuje, got N1.5 million each and rice while some orphans in the homes were awarded scholarships from nursery to university.
Iginla said he had 782 widows and orphans he caters for. “It doesn’t matter to me if I trek home as I have given even the car that I personally drive. “I can only drive one car and live in one house at a time. This understanding is what has taught me that when I die, others will inherit my assets.
“The beauty of life is not in its duration but in its donation. I have not seen some of the beneficiaries before in my life or spoken to them. “I’m seeing many of them for the first time today. I am seeing Jide Kosoko for the first time”, he said.

An 84-year-old man, Colin Dunn, and the love of his life, Sally Smith, 82, have finally married after dating for 44 years.
They first met in 1972 behind the bar of a social club Colin visited every weekend after work.
Though they have always been deeply in love and haven't looked back since then, the couple only got engaged last year.
Colin said: ‘Marriage never entered my head at that point. We were always so busy looking after the children or going on holiday to Blackpool. All of a sudden the children were growing up and leaving home and it was just me and Sally, so we thought it was finally time to become man and wife.’
He added: ‘We kept on saying, ‘it’ll be next year, it’ll be next year’ – but we were happy as we were.’
After a couple of heartbreaking losses within the family though, Sally and Colin decided to take getting married seriously.‘Just before last Christmas I lost my brother Harold and shortly before that I lost my eldest brother too,’ said Colin.
‘We were going through a bit of trouble and we started thinking what if this happened to one of us? We decided we wanted to be man and wife.’
And so finally, the pair, who are from Leeds, tied the knot at St Mary’s Church in Middleton among 100 of their friends and relatives, before heading over the social club where they first met to enjoy a meal after the ceremony.
Only in Obodoyibo and never in Naija where worries about even the most basic social amenities won't allow thoughts of love to flourish!
